Arizona Dealer to Pay Nearly $17,000 in Damages for Rolled Back Odometer

This office sued Dealer Trade Inc., doing business as Luxury Motorsports, in 2016 for odometer fraud and breach of contract for selling a 2010 Infiniti QX56 showing 35,648 miles, when a reasonable estimate of the mileage at the time of sale was well over 100,000 miles. Service records from the Infiniti dealership showed that the vehicle had had 47,731 miles four years prior to the sale to my client. The Court ultimately found no proof that Luxury Motorsports violated the odometer fraud act, but found that the mileage disclosure at the time of sale was not accurate. A trial to determine damages was held in September 2017. The Court ended up awarding a judgment against Luxury Motorsports in the amount of $16,859.75 for damages.
